Requirements

Your relationship

  • Both partners must be over 18 at the time of application
  • The sponsor (the person the applicant is joining) must either: 
  • have British citizenship or Indefinite Leave to Remain (ILR)
  • either be in the UK when the application is made or intend to return permanently to the UK once their partner’s visa is granted
  • You must be able to prove to the services that the applicant and sponsor have been in a ‘genuine and stable’ relationship for at least 2 years;
  • If you are married or in a civil partnership, the marriage will be valid if it was legal in the country where it was contracted and you will need to provide your marriage certificate. You must include the original certificate and a translation with your application. 
  • If you are not married yet, you can apply for an unmarried partner visa as long as you can prove that you have lived together for at least 2 years. You can do this by providing documents such as a letter from your landlord or letters addressed to both of you at the address where you live.

The English language test

  • The applicant must pass an English language test – at least English A1 level at one of the approved testing centres – you can find details of the approved centres here CERTIFICATE IN ENGLISH.
  • If the applicant is over 65 or has a disability or other exceptional circumstances that prevent them from passing the test, then you will need to provide independent documentary evidence of this.

Your finances and social situation

There are additional income requirements if you are in or out of work, accommodation and living arrangements requirements. But there are also exceptions for exceptional circumstances if you cannot meet the requirements.

The rules about who can apply and what evidence to include are complicated. This is why you need to seek expert advice on these matters from Atanas Chikov, a licensed immigration adviser. This will decide whether this type of visa is right for you and whether you meet the specified requirements.

What will you get?

Upon a positive decision and approval, you will receive a visa to stay in the UK for a specified period. 

We do not offer advice on completing the form on the government website and cannot guarantee a positive decision – it all depends on your details and circumstances.

How much does the service cost?

Our fee starts from £550.

The government spouse visa application fee starts from £1846 if you are applying from outside the UK.

There is also an immigration health fee which is £3105 for the 33 month visa for a spouse or other adult relative; or £2328 for a minor. There are certain exceptions – contact us for more details. 

There are other costs to consider such as the cost of translating a marriage certificate, taking a recognised English language test or getting a qualification certified by UK NARIC.

If the applicant is from certain countries, they will also need to take a TB test which can cost over £100 depending on where they are from and whether there is a Home Office approved testing centre nearby. 

Fee waiver

If paying the application fee and health fee will damage your budget to the extent that you can’t pay for essentials, you can apply for a fee waiver. If you qualify, you can apply without having to pay the fees.
